Conservation Agreement Updated to Align with Erosion and Stormwater Management OrdinanceFairfax County Land Development Services has updated the Conservation Agreement (Agreement) used for land disturbing activities regulated under the Erosion and Stormwater Management Ordinance, Chapter 124.1 of the County Code. The updates align the Agreement with Chapter 124.1. Key Updates Include:
- Replaces the term “Conservation Plan” with “Plan,” consistent with Chapter 124.1, which includes erosion and sediment control plans, stormwater management plans, stormwater facility construction plans, and landscaping plans, and requires compliance with the entire “Plan” and any county-imposed conditions.
- Updates legal references to Chapter 124.1 and Virginia Code §62.144.15:34.Streamlines provisions for corrective action, enforcement authority, and county access to the property.
- Expands conservation escrow deposit requirements, including use, replenishment, and release procedures tied to the applicable development agreement.
- Simplifies and clarifies tree protection language tied to the “Plan” and the Public Facilities Manual.
